    America's Cup: Kiwi wins battle to confiscate Oracle boat

    Marshals have been authorised to seize America's Cup champion Oracle Team USA's prototype boat in response to a lien filed by New Zealand sailor Joe Spooner, whose contract was terminated in January.

    Listed as defendants are Oracle Racing Inc. and the multihull foiling AC45 catamaran known as 4 Oracle Team USA, along with all of its systems and wing sail. Ellison is not named in the suit.
    The 45-foot catamaran Spooner is asking to have confiscated was built to foil, or ride up on hydrofoils once it reaches a certain speed. Oracle tested the boat on San Francisco Bay in February as it prepares to build a 62-foot catamaran that will be used to defend the America's Cup in 2017.

    Not really Americas Cup but spent yesterday watching in in port race with the Volvo 65's. Sat at the end of the wharf near the start line and the boats were about 20m away - magic.

    And the girls what a race, stayed with the code zero despite those following going for bigger asymmetrics. Brunel caught them right up in front of us, but then had to change down and lost all the ground they had made up whilst changing sails as the big asymmetric takes a lost a time to put away and you have to bear away a lot to get a a good roll.

    So we have two days wait as outside it blowing quite well and Pam has not reached us yet. They are packing all the village up today (IMHO a bunch of northern hemisphere pussies - it's no windier than a normal day in Wellington) but not sailing straigh through Pam is probably a good idea the islands have been hammered.

    So they now leave Tuesday next stop Brazil.

    What a shocking mess Pam made of the Port Vila and surrounds. Looks like a large proportion of the yacht fleet has been destroyed, let alone the land based losses of life and property. Will there be any leftover effect on the North Island? Strong as the 65's are, I wouldn't like to be on one in the conditions Vanuatu has just been through.

    Pam kept her distance but hit the east coast and cause a bit of damage, but nothing more than any winter storm. In Auckland we had a windy wet night, but again nothing more than a winter storm.

    The Chatham Islands are going to have a rough night but it's no longer a "super cyclone". It's not often cyclones come down south to the East of NZ they normally pass to the North and head towards Queensland. Fortunately for us it stayed a long way off the East coast, but the sailors will/would have had to sail straight through it and winds are now much less (they were >300 km/hr) as it moves into the colder southern waters but it is still a bloody big storm.

    Went to see the boats off today and the start is set back to 9am tomorrow morning (Wed.), but I'm not in the office tomorrow so will miss it

    But don't take my word for it.

    Luna Rossa pull out of the Cup in protest.
    Emirates Team New Zealand with no govt. funding as now no Auckland round (One way to kill of the competition).

    Bruno Trouble, America's Cup sailor, writing in the sailing website Scuttlebutt, said: "Golden Gate Yacht Club, and their Oracle Team USA, are great sailors but hopeless guards of the Myth. They managed to kill the style and elegance which prevailed for decades, those unique aspects of the America's Cup ... They have discouraged high level partners and put an end to the exclusive positioning of The Cup. They have betrayed the long saga of incredible personalities who made the Cup so special. And they are now organising a one-design catamaran contest with no style and anonymous people beyond the sailing circles. "What we have now is a vulgar beach event smelling of sunscreen and french fries.

    This is definitely NOT the Cup."

    And then no defenders series even the New York Yatch Club was that pompous.

    It's now just another one class cat event -- BORING!

    Let's hope somebody can get it off them before they are sailing it in Moths!

    To my way of thinking, bringing costs down helps New Zealand to field a boat. I will follow the event and give them the benefit of the doubt and see what they come up with. There are sure to be more entrants. Do you think they will cap spending? Would the United Arab Emirates funding still be available to New Zealand? The smaller boats will still be very fast.

    Stephen Sorry but really I don't care any more. Going from real boast to the 72ft was a mistake, now it's just another one design class. When Larry looses it lets hope it will go back to being what it is supposed to be match racing.

    I just returned from a bicycle ride that went through the old navel base in Alameda past where Artemis staged their last AC event. There is no trace of them even being there. The building near the water is gone. It must have been modular and easily torn down. I do not know if they owned or rented. There was no foundation, it sat on the tarmac in a big lot.

    I just returned from a bicycle ride through the old Alameda Naval Station. To my surprise Artemis was out sailing an AC 45 on the bay.. There was no advertising displayed on the wing. They seamed to be testing a lite wind sail at the front of the boat.The sail was black with no markings.

    Well walked pass the Team NZ base yesterday and they are pulling it down to make way for a Hotel. So another waterfront icon gone.

    They have moved to the old Prada base around the back end of beyond so i won't see team in the sushi bar anymore for lunch

    Now I live in Australia the chances of me seeing anything is probably zero even with Oracle driven by an Aussie

    But I do have it marked in my cal - yeah I know I said I didn't care but I'm still a kiwi and want Team NZ to win. Who will about the last team to arrive BTW so the competition does not get too many clues about what they've done this time (although it's now almost a one design series - really boring, like NASCAR or Indy Car -v- F1

    The AC should not last as long this time. They are saying that the boats this time are far superior and faster. There are more challengers this time also. I will definitely be watching.
